Fire insurance will normally only pay out after a fire not to prevent one. I think these are banned across much of Europe but not in the UK. If they are banned in the UK then there will,be no doubt where the liability lies which is whoever authorised putting them on but given the ubiquity of them seems unlikely. If put up before a ban (if there is one) there would normally no requirement to replace unless there is a specific law to enforce but it might make fire insurance difficult.

In my experience, older homes or ones that have been refitted with a wood stove will need to pass an inspection in order to be insured.
As for the legality of this cladding, it's my understanding that in the UK, US and much of Europe that it met standards for smaller buildings but was not supposed to have been used in taller buildings such as the Grenfell Towers. The manufacturers of the cladding made similar claddings that were fire resistant and also some that were non-combustible and even sales literature mentions their unsuitability for high rise structure.
So who screwed up? The salesman that sold it should have known, the purchaser could have just read their specs if ze didn't already know better. Did inspectors or engineers oversee the application? It would seem that it wouldn't take a rocket surgeon to figure it shouldn't have been allowed.
